Terms and Conditions

At a glance

These Terms are the agreement between you and FilmConnector. They cover what we promise to deliver, what you commit to in return, how billing and cancellation work, what you can and cannot do on the platform, and what happens if something goes wrong.

Three things to know before reading further:

  1. A FilmConnector subscription runs for a minimum of 12 months. This matches the rhythm of a film's festival journey. You can pay monthly or annually, with a 12.34% discount when you pay the year upfront.
  2. You get a 9-day trial. No card is charged during the trial. You can cancel at any moment in those 9 days and walk away with no commitment.
  3. You always own your work. Your synopses, press kits, project notes, and submission strategies remain yours. We need a narrow licence to host and display them inside the platform — nothing more.

1.Definitions

In these Terms, capitalised words have the meanings set out below.

"FilmConnector", "we", "us", "our"
[LEGAL ENTITY NAME], a Belgian company registered at [REGISTERED ADDRESS], BCE/KBO [BCE NUMBER], VAT [BE VAT NUMBER].
"You", "your", "Subscriber"
The individual or company that has accepted these Terms by subscribing to FilmConnector.
"Service"
The FilmConnector platform: the website, the web application, the mobile application, and all features offered through them.
"Account"
Your registered identity on the Service.
"Subscription"
Your paid right to use the Service, governed by these Terms and the tier you have selected.
"Tier"
Iris, Aurora, Zenith, Eclipse, or Constellation, as described in Section 7.
"Project"
One short film for which you use the Service to manage festival strategy, submissions, and related work.
"Collaborator"
A person you invite to a Project (for example, the producer, director, an assistant, a national promotion agency, a funder).
"Agency Team Seat"
An additional full-account user provisioned on Eclipse and Constellation tiers.
"User Content"
Synopses, press kits, screener links, project notes, submission strategies, and any other content you create, upload, or store within the Service.
"Phase 1"
The workflow + community + access layer of the Service, available at launch.
"Phase 2"
The AI intelligence layer, defined in our published roadmap, target launch 2027.
"Cycle I"
The founding-member programme described in Section 12.
"GDPR"
Regulation (EU) 2016/679.
"Trial"
The 9-day no-charge evaluation period described in Section 8.

2.Who can use FilmConnector and how this agreement is formed

You may subscribe to FilmConnector if you are at least 18 years old, have legal capacity to enter into a binding contract, and (if subscribing on behalf of a company) have authority to bind that entity.

By starting the checkout flow, ticking the acceptance box, and proceeding past the order summary, you accept these Terms. The agreement is formed at that point. We will send you a confirmation email containing your order, the applicable Terms, and the Privacy Policy.

You may not assign or transfer your Subscription to another person without our prior written consent.

3.Your account

You are responsible for keeping your Account credentials secure. You must provide accurate registration information, use a strong unique password, not share your Account, and notify us promptly at integrations@filmconnector.app if you suspect unauthorised access.

You are liable for any activity carried out under your Account, except where you have notified us of unauthorised access and we have failed to act on that notice in good time.

4.The Service we provide

FilmConnector is a professional platform for filmmakers, sales agents, and festival strategists. The Service offers access to a database of approximately 2,200 festivals, a strategy creator, a submission tracker with deadline alerts, Project workspaces with Collaborator seats, press kit templates, and (in Phase 2) AI features.

We do not provide:

  • Hosting of the video file itself.
  • A guarantee that any festival will accept your film.
  • A guarantee of any commercial outcome (sales, awards, distribution).
  • Legal, tax, or financial advice.

The judgments you make using the Service — which festivals to submit to, which strategies to follow — are yours.

5.Your Project content and intellectual property

5.1 Ownership

You retain all intellectual property rights in the User Content you upload to or create within the Service. Nothing in these Terms transfers ownership of your work to FilmConnector.

5.2 Licence to operate the Service

To operate the Service, you grant FilmConnector a worldwide, non-exclusive, royalty-free licence to host, store, display to authorised users, process through AI features (Phase 2, only when you use them), forward to festivals at your instruction, and make minor technical modifications needed for the Service to function. The licence ends when your User Content is deleted per our Privacy Policy.

We will not use your User Content to train third-party foundation models without your separate, explicit consent.

5.3 Your responsibility for uploaded content

By uploading User Content you confirm that you own it or have all necessary rights, that it does not infringe third-party rights, and that it does not contain unlawful content. We may remove content that we reasonably believe violates these Terms.

6.Collaborators on your Projects

Each Project includes 5 Collaborator seats. When you invite a Collaborator: you decide who joins and what they see; you are the data controller for their personal data; FilmConnector acts as your data processor on your instructions. The Collaborator must accept a Collaborator Acceptable Use Notice at first sign-in.

When you remove a Collaborator or your Subscription terminates, access is removed. A Data Processing Addendum reflecting this split is available on request.

7.Subscription tiers and pricing

7.3 VAT and taxes

Prices shown to EU consumers include Belgian VAT (21%). B2B customers with a valid VAT number are billed VAT-free under the EU reverse-charge mechanism. You are responsible for any taxes imposed by your country beyond VAT shown at checkout.

7.4 Add-ons

  • Extra Project: €12.34/month (€123.40/year) per additional Project, any Tier. Prorated when added mid-cycle.
  • Extra Collaborator seat: €3.34/month (€35.13/year) per seat, any Project. Prorated when added mid-cycle.

7.5 Minimum term

A Subscription runs for a minimum of 12 months and auto-renews for further 12-month periods unless cancelled per Section 10. The 12-month minimum reflects the rhythm of cinema and festival cycles.

7.6 Agency Team Seats

Eclipse includes 5 Agency Team Seats; Constellation is negotiated in the Order Form. Sharing a seat among multiple individuals is not permitted.

8.Trial period

  • Monthly plans — 9-day no-charge Trial beginning when your card is registered. Annual plans carry no Trial (paid upfront at 12.34% discount).
  • Full access during the Trial. Cancel any time via account settings or by emailing us — no charge, no further obligation.
  • We send a reminder on day 6. If you have not cancelled by 23:59 Belgian time on day 9, your Subscription converts on day 10 and the 12-month Term begins.

9.Billing, payment, taxes

  • All payments processed by Stripe Payments Europe Ltd. We do not store full card numbers.
  • Accepted methods: SEPA Direct Debit, all major cards, bank transfer (annual upfront only).
  • Failed payments: Stripe retries on its standard schedule. No payment within 14 days → suspension. No payment within 30 days → termination for cause (Section 17.3).
  • Invoices issued in EUR, retained for 7 years per Belgian commercial law.

10.Auto-renewal and cancellation

Subscriptions auto-renew 12-monthly. We send a renewal reminder 30 days before the Term ends. Cancel auto-renewal any time through your billing area or by writing to us — effective at end of current Term.

The 12-month minimum Term is binding once the Trial converts. Mid-term refunds are not available except: during the 9-day Trial; where EU withdrawal rights apply (Section 11); documented hardship cases (write to us); or where we materially breach and fail to remedy (Section 17.4).

On termination: access ends the day after Term ends; User Content is retained 90 days for recovery then deleted; outstanding invoices remain due.

11.Right of withdrawal (EU consumers)

11.1 Your right

EU consumers have the right to withdraw within 14 days of contract conclusion, without reason or cost beyond the value of Service supplied during that period.

11.2 How to exercise

Send an unambiguous written notice to integrations@filmconnector.app before the 14-day window expires. You may use the model form in Annex A.

11.3 Reimbursement

If you withdraw in time, we reimburse all payments within 14 days, using your original payment method. If Service was supplied during the withdrawal period, we deduct a pro-rata amount for days used (for monthly subscribers converting after the Trial, typically less than €5).

11.4 Business customers

The right of withdrawal does not apply to B2B subscribers.

12.Founding-member offer (Cycle I)

12.1 Eligibility

The first 134 paying Subscribers across all Tiers become Cycle I founding members, recorded at the moment of first charge, in order of payment.

12.2 What founding members receive

  • Price-lock until 2034-12-31 — your rate cannot be raised for continuous Subscription up to that date. Cancelling forfeits the lock.
  • Phase 2 AI bundle — included at no price increase when it ships, covering the specific AI features in the Phase 2 roadmap published at the time of your subscription.
  • Cycle I mark — visible in your account.

12.3 What is NOT included

Capabilities beyond Phase 2 — Phase 3 onward, future AI generations, new modules introduced after Phase 2 launch — are priced separately at their time of release, even for Cycle I members.

12.4 Closure and non-transferable

Cycle I closes when the 134th paying Subscriber's first charge is processed. Cycle II opens in 2027 at refreshed pricing. Cycle I status is personal to your Subscription and cannot be transferred.

13.Add-ons

Add-ons attach to and follow the lifecycle of your Subscription. They are prorated when added mid-cycle and terminate with the Subscription. See Section 7.4 for pricing.

14.Festival submissions forwarded through the platform

When you instruct FilmConnector to forward a submission, you authorise us as your limited agent for that submission. We will transmit the data the festival requires, record the submission in your tracker, and (where supported) pay festival fees you have authorised.

We do not:

  • Guarantee selection, screening, scheduling, or commercial outcomes.
  • Pre-vet festivals' selection decisions.
  • Assume responsibility for the festival's handling of your data after submission.
  • Indemnify you against the festival's decisions or actions.

Disputes about a festival's decisions are between you and the festival directly.

15.AI features (Phase 2)

When Phase 2 AI features ship: they process content only when you choose to use them; we do not use your content to train third-party models without separate explicit consent; AI output is a recommendation — you retain full discretion; no solely automated decisions with legal or significant effects are made. You can disable AI features at any time; the Service continues with the manual workflow.

16.Acceptable use and prohibited conduct

You agree not to:

  • Upload content you don't have rights to use, or that infringes third-party rights.
  • Send spam, unsolicited communications, or malware.
  • Access another Subscriber's Account without authorisation.
  • Reverse engineer, decompile, or disassemble the Service.
  • Scrape or extract the festival database for use outside the Service.
  • Use the Service to compete with FilmConnector by replicating its core features.
  • Submit films to festivals as an unauthorised third-party broker.
  • Use the Service in violation of applicable law.
  • Interfere with the Service's operation, security, or availability.

17.Suspension and termination

You may decline auto-renewal per Section 10. We may suspend or terminate for cause (with 14 days' notice to remedy, or immediately for incurable breaches) if: payment fails beyond 30 days; you materially breach these Terms; you use the Service for unlawful conduct; a regulator requires us to; or you become insolvent.

If we materially breach and fail to remedy within 30 days of your written notice, you may terminate and receive a pro-rata refund of unused prepaid fees. Sections 5.1, 5.3, 11, 16, 18–23, 25, 27 survive termination.

18.Data protection and privacy

Our collection, use, and protection of personal data is governed by our Privacy Policy, incorporated by reference into these Terms. For B2B Subscribers, a Data Processing Addendum is available on request. You confirm you have a lawful basis for any personal data you upload or share through Collaborator invitations.

19.Confidentiality

Confidential information shared with you (programmer intelligence, mastermind discussions, product roadmaps) may only be used for the purpose for which it was shared and must not be disclosed to third parties. This obligation continues for 3 years after termination (trade secrets: indefinitely). It does not apply to already-public information or legally required disclosures.

20.Service availability, support, modifications

We aim for continuous availability but do not guarantee it. No formal SLAs at consumer tiers (Eclipse includes response targets; Constellation may include negotiated SLAs). Support by email at integrations@filmconnector.app: Iris/Aurora best-effort ~3 days; Zenith ~1 day; Eclipse same day; Constellation per Order Form.

Material feature removals are communicated at least 60 days in advance; if a removal materially diminishes your Subscription's value, you may terminate within 30 days for a pro-rata refund.

21.Disclaimers and limitation of liability

21.1–21.2 Disclaimers

The Service is provided "as is". We disclaim implied warranties to the maximum extent permitted by law. We do not warrant that the Service will result in festival selection, sales, distribution, or any commercial outcome.

21.3 Limitation of liability

Our total aggregate liability in any 12-month period shall not exceed the fees you paid to us in that period. We are not liable for indirect, incidental, special, consequential, or exemplary damages including loss of profits, revenue, goodwill, data, or business opportunity.

21.4 What is not limited

Nothing limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be lawfully limited. Consumer statutory rights are unaffected.

22.Indemnity

You agree to indemnify FilmConnector from claims arising from your User Content, your breach of these Terms, or your violation of third-party rights or applicable law. This indemnity is limited as required by Belgian consumer law and does not apply where the claim arises from our own breach or negligence.

23.Force majeure

Neither party is liable for delay or failure caused by events beyond reasonable control (natural disasters, war, pandemic, internet outages, government action), provided reasonable efforts are made to resume performance.

24.Changes to these Terms

Non-material changes take effect on publication. Material changes (price changes for non-Cycle-I Subscribers, new fees, liability or governing law changes) are announced by email at least 60 days in advance; if you do not accept, you may terminate at next renewal without penalty. Cycle I pricing is protected until 2034-12-31.

25.Governing law and dispute resolution

These Terms are governed by the laws of Belgium. EU consumers also benefit from mandatory consumer protection rules of their country of residence. Business disputes: exclusive jurisdiction of the courts of Brussels. Consumers may also bring proceedings in their country of residence.

26.Notices and communications

Notices to you go to your registered email — keep it current. Notices to us: integrations@filmconnector.app or by registered post to [LEGAL ENTITY NAME], [REGISTERED ADDRESS], Belgium.

These Terms are in English. In case of conflict between language versions, English prevails for B2B; for consumers the version in their language of residence prevails where required by mandatory law.

27.Miscellaneous

  • Entire agreement — these Terms, Privacy Policy, Cookie Policy, and (for B2B) MSA and DPA form the entire agreement between us.
  • Severability — invalid provisions are modified minimally or severed; remaining provisions remain in force.
  • No waiver — failure to enforce a right does not waive it.
  • No agency — no partnership or employment is created beyond the limited agency in Section 14.
  • Third-party beneficiaries — subprocessors, directors, and employees benefit from the limitations in Sections 21–22. No other third parties have rights under these Terms.
